When you fail a DOT drug or alcohol test, you are immediately removed from safety-sensitive duties. To get back in the driver's seat, you must successfully navigate the Return-to-Duty (RTD) process. Here is a clear breakdown of the 6 mandatory steps.
Step 1: The Initial SAP Evaluation
Your first move is to hire a DOT-qualified Substance Abuse Professional (SAP). During this initial clinical interview, the SAP will assess your relationship with drugs and alcohol, review the circumstances of your violation, and determine the level of assistance you need. Honesty is critical here.
Step 2: The Recommended Treatment Plan
Based on your evaluation, the SAP will prescribe a customized treatment or education plan. By law, the SAP must prescribe some form of education or treatment—they cannot simply clear you. This could range from a short 4-hour online drug awareness course to intensive inpatient rehabilitation.
Step 3: Completing the Education/Treatment
You must complete the exact curriculum prescribed by your SAP. You cannot substitute it for a different class or a cheaper option. Once you finish, your education provider will send written documentation to your SAP confirming your successful completion.
Step 4: The Follow-Up Evaluation
After your SAP receives proof of completion, you will meet with them again. The purpose of this follow-up interview is to demonstrate that you have successfully complied with the treatment plan and absorbed the material. If the SAP is satisfied, they will issue a Notice of Compliance.
Step 5: The Return-to-Duty Drug Test
You are now eligible to take a Return-to-Duty drug test. Important: You cannot schedule this test yourself. It must be ordered by a prospective employer (a SAP-friendly trucking company) or your current employer. The test will be conducted under direct observation. Once you pass, your Clearinghouse status changes to "Not Prohibited."
Step 6: Follow-Up Testing
Passing the RTD test gets you back on the road, but the process isn't entirely over. Your SAP will prescribe a strict follow-up testing schedule. The DOT requires a minimum of 6 unannounced tests over the first 12 months, but the SAP can order testing for up to 60 months. Your employer is responsible for managing this schedule.
