What If I Disagree With My SAP's Treatment Plan?

You complete your initial SAP evaluation, expecting to be assigned a simple 8-hour online education class. Instead, the SAP prescribes 8 weeks of expensive, in-person intensive outpatient therapy. You feel it is completely unfair and unjustified. Can you just fire them and find a new SAP?

The DOT "No Second Opinion" Rule

The short answer is: No. You cannot get a second opinion.

The Department of Transportation strictly prohibits "SAP Shopping." According to 49 CFR Part 40.295, once you have begun the initial evaluation process with a SAP, you are legally bound to that specific SAP and their prescribed treatment plan.

What if the SAP is Actually Unprofessional?

While you cannot get a second opinion on the clinical diagnosis, there are very rare, extreme circumstances where you can change SAPs:

• The SAP loses their DOT credentials. (e.g., their state clinical license expires or is revoked).
• The SAP becomes physically unavailable. (e.g., they retire, pass away, or close their practice).
• Extreme Unprofessionalism. (e.g., they attempt to extort you for more money outside the agreed fee, or they sexually harass you).

In these extreme cases, you must contact your employer's Designated Employer Representative (DER). The employer is the only entity authorized to consult with the DOT and officially transfer your case to a new SAP.

The Importance of Choosing Right the First Time

Because of the "No Second Opinion" rule, the most important decision you will make in the entire Return-to-Duty process is which SAP you hire on day one.

You must do your research. Do not just pick the cheapest SAP you find on Google. Read their reviews, ensure they have transparent pricing, and look for providers who specialize in transportation workers. A good SAP wants you back on the road safely, not trapped in an endless loop of expensive therapy.
