Does a Failed Drug Test Stay on My CDL Record Forever?

One of the biggest fears drivers have after a violation is that their career is permanently branded. The good news? No, a failed drug test does not stay on your record forever. The FMCSA has very specific rules about how long a violation is visible to employers.

The 5-Year Rule

According to the Federal Motor Carrier Safety Administration (FMCSA), a drug or alcohol violation will remain in the Drug and Alcohol Clearinghouse for a period of five (5) years from the date of the violation.

However, that 5-year clock only applies if you actually do the work to fix it.

What This Means For You

If you fail a test today and do absolutely nothing about it, that violation will remain on your Clearinghouse record for the rest of your life. It will never age off. It will be permanently listed as "Prohibited."

To get the 5-year countdown to stick, you must complete the SAP program, pass the Return-to-Duty test, and complete all follow-up tests prescribed by your SAP. Once the follow-up testing is finished, the violation will drop off the Clearinghouse exactly 5 years from the date the violation originally occurred.

What Do Employers See During the 5 Years?

During those 5 years, any prospective employer who runs a pre-employment query on you will see the violation.

However, they will also see your progress. If you are completing the steps, they will see that your status is "Not Prohibited" and that you are currently in the follow-up testing phase. This shows employers that you took accountability and are legally cleared to drive, which is exactly what SAP-friendly companies are looking for.
